Hi Jason, I looked into the TMR datasets but all the datasets I could found only contained the major state owned roads e.g http://data.qld.gov.au/dataset/state-controlled-roads-queensland not local roads.
I noticed on an OSM wiki that permission had been acquired from TMR but not from other government agencies. I found a dataset on data.qld.gov.au that included local roads. https://data.qld.gov.au/dataset/physical-road-network-queensland but this was owned by the Department of Natural Resources and Mines. There license seemed to allow use on OSM but I emailed them to confirm. Their reply in part was: Yes, in the dot point 3 of the Permitted Use section of the Open Licence it says:- “You may create and distribute hardcopy and digital products based on or containing the supplied data, provided all the following conditions are met “ etc. You may use the data and create other hardcopy and digital products for your own personal use but you are not permitted to on sell the original dataset.
