*Fiqh of Hadeeth "Do not Support the Shaytaan..."*

بسم الله الرحمن الرحيم والصلاة والسلام على خير المرسلين وعلى آله وصحبه
الأطهار أجمعين أما بعد

السلام عليكم ورحمة الله وبركاته


Abu Huraira reported that a man was caught drunk from alcohol, so he
commanded to punish him. Upon the command of Allah's Messenger (صلى الله
عليه وسلم) some of us started hitting him with their hands while others used
their shoes and others used their garments. After the man left (i.e. after
being punished) one man said (i.e. addressing the punished man) " what is
wrong them him, May Allah disgrace him". The Prophet (صلى الله عليه وسلم)
said :" Let none of you be a support or help to the Shaytaan against your
(Muslim) brother"

This Hadeeth is documented in Sahih Bukhari; hadeeth No. 6781. Similar
hadeeth with different incidents was reported from the way of Abu Al-dard'a
and Ibn Masoud but these narrations are slightly defected but can be
accepted based on the authentic Hadeteh above.

The Fiqh of this Hadeeth:

1. It is impermissible to supllicate a Dua'a against Muslim sinners esp.
statements that consist Allah's warth or Curse against this Sinner.

2. Initiating such Dua'a is Makrouh Tanzeehan if it what is been said (in
the dua'a) is not meant and it is Haram if the what is said in the dua'a
meant. Nevertheless, the manner of Muslim and the guidence of the Prophet to
abstain from doing it regardless based on other authentic Hadeeths that
condemn flithiness of the tongue and criticize bad wording.

2. Making Dua'a against Muslims is not allowed because it is a form of
harming Muslims and Hadeeths are clearly prohibt it

3. It is preferable that one make Dua'a for the sinner that Allah forgive
him and shelter him under His Mercy according to other narrations of the
same Hadeeth in which the Prophet (صلى الله عليه وسلم) said: " Ask Allah to
bestow His mercy upon your brother" and in another one " O Allah forgive
him"

4. Making Dua'a against sinners should be in general and not addressing
individuals based on other authentic known hadeeths. This is based on the
fact that Allah's Messenger صلى الله عليه وسلم cursed the one who drink
alcohol but in this hadeeth condemned it. That is because he cursed those
who drink in general and did not allow it when it is specific.

5. Making Dua'a against sinners might drive sinners away from repentance and
cause them to react with arrogance and pride

6. Cusring individuals is a matter of dispute amongst scholars and each view
has their own evidences. However, the safest is to abstain from doing it as
this comply with the authentic hadeeth " avoid doubtful matters...guard your
religion and honor". That said, the best to follow what is agreed on that
Dua'a against sinners should be made, if one would like to, in general terms
and not addressing individuals.

7. The meaning of " do not support the Shaytaan against your brother" that
the Shaytaan aims to cause humiliation and abasement to sinners so when one
make dua'a against him (the sinner) caused the sinner to feel so and that is
the purpose of the Shaytaan.

It is important that average Muslims to observe the best manners when it
comes to deal with their Muslim fellows even if they were sinners.
Furthermore, showing love, Mercy and Humility to our Muslim fellows should
not affect the rule of "joining the right and disjoin the wrong". However,
one should seek the best approach with the best manners because the
importance of this rule is not to apply it but rather to acheieve the
purpose of it i.e. having our mulsim fellows who commit sin repent and be
good to fulfil the other Hadeeth: "None of you shall believe until he loves
for his brother what he loves for himself. So, since everyone loves to be
the best example and righteous then that is one thing to love for others and
always keep in mind that what seems obvious to us might seem vague to others
and having opur hearts easily accepting truth does not necessirly mean
everyone is the same.

I ask Allah to unite Muslim hearts and enrich our heart with Imaan and let
us be mirrors that reflect each other as Allah's Messenger said.
