*ഹോം * <http://www.mathrubhumi.com/index.php> *ലേറ്റസ്റ്റ് ന്യൂസ്*<http://www.mathrubhumi.com/liststory.php?sub=362> മുസ്ലിം സംവരണം: ആന്ധ്ര സര്ക്കാറിന്റെ തീരുമാനം ഹൈക്കോടതി റദ്ദാക്കി Posted on: 09 Feb 2010 ഹൈദരാബാദ്: മുസ്ലിം സമുദായത്തിലെ പിന്നാക്കവിഭാഗങ്ങള്ക്ക് വിദ്യാഭ്യാസ സ്ഥാപനങ്ങളിലും തൊഴില്മേഖലയിലും നാലുശതമാനം സംവരണം നല്കാനുള്ള ആന്ധ്രപ്രദേശ് സര്ക്കാറിന്റെ തീരുമാനം ഭരണഘടനാവിരുദ്ധമാണെന്ന് ആന്ധ്ര ഹൈക്കോടതി വിധിച്ചു. ചീഫ് ജസ്റ്റിസ് എ.ആര്. ദാവെ തലവനായുള്ള ഏഴംഗ ഭരണഘടനാബെഞ്ചാണ് സര്ക്കാര് തീരുമാനം റദ്ദാക്കിയത്. മുസ്ലിം സമുദായത്തില് സാമൂഹികവും വിദ്യാഭ്യാസപരവുമായി പിന്നാക്കംനില്ക്കുന്ന 15 വിഭാഗങ്ങള്ക്ക് വിദ്യാഭ്യാസസ്ഥാപനങ്ങളില് നാലു ശതമാനം സംവരണംനല്കാന് 2007 ജൂലായ് 27നാണ് സംസ്ഥാനസര്ക്കാര് നിയമം കൊണ്ടുവന്നത്. ആന്ധ്രാസര്ക്കാറിന്റെ പിന്നാക്കവിഭാഗകമ്മീഷന് റിപ്പോര്ട്ടിന്റെ അടിസ്ഥാനത്തിലായിരുന്നു ഇത്. ഹൈക്കോടതിയുടെ ഏഴംഗ ഭരണഘടനാബെഞ്ചില് അഞ്ചുപേര് നിയമത്തിനെതിരെ വിധി രേഖപ്പെടുത്തി. ഒരാള് നിയമത്തെ അനുകൂലിച്ചു. ഏഴാമന് ഒരഭിപ്രായവും പറഞ്ഞില്ല. എല്ലാ മുസ്ലിങ്ങള്ക്കും അഞ്ചുശതമാനം സംവരണം ഏര്പ്പെടുത്തിയ നിയമം നേരത്തേ ഹൈക്കോടതി തള്ളിയിരുന്നു. അപ്പോഴാണ് മുസ്ലിങ്ങള്ക്കിടയിലെ 15 ഓളം പിന്നാക്ക വിഭാഗക്കാര്ക്കായി നാലുശതമാനം സംവരണം ഏര്പ്പെടുത്തി രാജശേഖര റെഡ്ഡി സര്ക്കാര് പുതിയ നിയമം കൊണ്ടുവന്നത്. നേരത്തേ ഈ കേസില് സ്റ്റേ ആവശ്യപ്പെട്ടത് ഹൈക്കോടതി നിരസിച്ചത് സുപ്രീംകോടതിയിലും ചോദ്യംചെയ്തിരുന്നു. എന്നാല് സുപ്രീംകോടതിയും സ്റ്റേ നല്കാതെ കേസ് പരിഗണിക്കാന് ആന്ധ്രാ ഹൈക്കോടതിയോട് ആവശ്യപ്പെടുകയായിരുന്നു. അഭിഭാഷകനായ കെ. കൊണ്ടലറാവു നല്കിയ ഹര്ജിയിലാണ് വിധി. വിധിക്കെതിരെ സുപ്രീംകോടതിയില് പ്രത്യേകാനുമതി ഹര്ജി നല്കാന് മുഖ്യമന്ത്രി കെ. റോസയ്യ അഡ്വക്കറ്റ് ജനറല് ഡി.എസ്.ആര്. മൂര്ത്തിക്ക് നിര്ദേശംനല്കി. സംസ്ഥാനത്തെ പിന്നാക്കക്കാരായ മുസ്ലിങ്ങള്ക്ക് നാലുശതമാനം സംവരണം നല്കാന് സര്ക്കാര് പ്രതിജ്ഞാബദ്ധമാണെന്ന് അദ്ദേഹം പ്രസ്താവനയില് വ്യക്തമാക്കി. _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ The information contained in this communication is intended solely for the use of the individual or entity to which it is addressed and others authorized to receive it.
