A copyright stands no matter whether the book is in or out of print. It is meant to protect the commercial interest of the owner. These people who circulat an illegal ecopy may have bought McCann's books if they were in print. Such circulation as Mohan plans may hurt the author's chances of getting it in reprint again. So the copyright would be violated. The author owns the right to copy, you see.
