Hi All, This mail is about regulations/laws as far as felling/pruning of trees in residential areas is concerned.I need opinions/thoughts/action points on the incident mentioned below.Kindly help. A few days ago I noticed a tree being chopped from its trunk below my building.The person, who resides in the same building as me, who initiated this said that he has the required permission from the municipal corporation.However, when I asked to see for the papers he said that he doesn't have them and that they are with the municipal corporation itself. Since no proof was produced for the required papers, I asked the 'arborists' to pack up and leave.The tree , in my opinion, was unnecessarily and excessively pruned and was about to be cut. I came upon the 'Maharashtra (Urban Areas) Preservation of Trees Act, 1975' . I am in the process of initiating an RTI. However, till that time if you have more information on the below,please reply: 1.When a person acquires a permission from the municipal corporation, for reasons like branches damaging cars parked underneath,does the permission explicitly state how much of the tree can be severed/how many branches should be pruned? 2.On what grounds can a permission be granted to chop even the trunk of the tree? 3.Is an official required to be present at the site when the tree is being pruned/chopped to monitor exactly how ,much of the tree be pruned? 4.Shouldn't the arborists/people involved in pruning the branches/chopping the tree, have with them the necessary legal documents while pruning the branches/chopping the tree? 5.In case, an objection is raised and the required documents are not produced, isn't it legal to stop the pruning the branches/chopping the tree immediately? 6.Whose responsibility is it if the tree is excessively pruned/severed to the point of rendering it useless? 7.What are a citizens rights as far as challenging a municipal permission to chop a tree/excessivley prune a tree? 8.Last but not the least,Shouldn't even pruning the branches be the last option? meaning can't we try solutions like: a. (in this case) Park car somewhere else? b: Tie off the allegedly menacing branches? c: Try a mesh net, the ones used in construction sites to keep off concrete and other debris from falling down, incase the branches give way? d: Support the branches in some way so that they don't fall? Request you to kindly shed light on the above points.If you have more things to add kindly do so as well. What worries me the most is the fact that a permission was granted on some frivolous grounds.Is it that easy to hurt a tree??
