"Innocent until proven guilty" secara yurispundensi hukum pidana berarti dalam suatu sidang (legal proceeding) institusi hukumlah yang wajib membuktikan dan meyakinkan hakim (atau judiciary body lainnya) bahwa kita bersalah, bukan kita yang harus membuktikan diri kita tidak bersalah. Di negara2 menganut hukum positif ini para tertuduh (terdakwa??) disebut defendant.
Kaya kasus pidana Prita, maka jaksa hrs mmbuktikan (dan meyakinkan hakim) dia bnr2 menyalahgunakan internet utk menyebar berita gak bener (shg melanggar UU ITE --> delik pidana). Syg kasus perdatanya (pencemaran nama baik) sy gak ngikutin.
