Not if those "extra" files have the same names as files in the
repository -- *that's* what causes the "in the way" messages.  When you
do an update, CVS sees that those files aren't in CVS/Entries and wants
to check them out, but you already have files with the same names in the
working directory so it can't.

That won't cause "in the way" messages.

Doing *anything* as root that doesn't absolutely have to be done as root
is a bad practice.
