Alexander, I have browsed the doc/ChangeLog and figured out approximately when these features were added.
We already have ways to deal with old servers, but am now looking to use Is-modified request instead of Modified and save sending a file up to the server. I was looking for the impact of such a change. As far as the disclaimer goes, alas I have no control. Our lame email gateway automatically appends it to outgoing messages.
