The Zeitschrift fuer Menschenrechte / Journal for Human Rights (zfmr)
invites paper proposals for its 1/2012 issue on "Punishment and Human
Rights".

From a human rights perspective, the legitimacy of sanctions based on
domestic or international law seems to relate primarily to the
punishment of severe human rights violations, for example in the
context of humanitarian interventions or rulings of the International
Criminal Court. However, the principle of punishment is a much more
fundamental problem within the context of human rights: the
legitimacy of each polity that is based on the rule of law depends on
how it deals with "deviant behavior" or with its declared "enemies".

For its 1/2012 issue on "Punishment and Human Rights", the zfmr
invites submissions addressing the following (and many more)
questions:

- What should we make out of the paradoxical legal principle that one
  evil is compensated with another, that is, the infringement of the
  fundamental rights and freedoms of the offender?
- Are the diverse goals of criminal justice – retribution, special
  and general prevention, rehabilitation – truly compatible with human
  rights?
- Which concrete punitive measures are in harmony with the principle
  of human dignity? The death penalty? Livelong imprisonment?
  So-called preventive detention? Would electronic shackles contribute
  to a more dignified application of criminal law?
- How has criminal law transformed in response to the September 11
  attacks? Is there a tendency towards practices of punishment beyond
  the rule of law and the constitutional state if terrorists are
  placed "outside" of the boundaries of law in the sense that they can
  be punished more severely than ordinary offenders?

We are looking forward to a broad range of contributions from diverse
disciplinary, political and activist backgrounds.

by December 30, 2011.

The zfmr is the only interdisciplinary journal on Human Rights
published in Germany. It publishes both German and English articles.
