Ago: Corruption law cannot be applied to Robert Tantular Friday, January 22, 2010 03:21 WIB | National | Jakarta (ANTARA News) - The Attorney General`s Office states the corruption law could not be imposed upon Robert Tantular because he has been convicted based on the banking law. "Robert Tantular cannot be charged again based on the corruption law because one cannot be prosecuted and sentenced twice upon the same crime," deputy attorney general for special crimes Marwan Effendy said here on Thursday. The Jakarta higher court has increased the sentence for Robert Tantular who partly owned PT Century Bank Tbk. from four years in prison, meted out earlier by the district court, to five years plus a fine of Rp5 billion. The panel of judges sentenced Robert Tantular for violating the Banking Law Number 10 of 1998. The Attorney General Office has grilled Robert as a witness for suspects Hesyam Al Waraq (the Century Bank commissioner) and Rafat Ali Rizvi the Century Bank`s controlling shareholder) now still at large. The office has declared the dossiers of the two suspects complete and would soon try the two in absentia. The two have been accused of swindling the Century Bank assets and conducting money laundering. The government injected Rp6.7 trillion to bail out the bank to prevent it from collapsing in the midst of a world economic crisis in 2008 causing a controversy that led the House of Representatives (DPR) to set up an inquiry committee to investigate if a foul play had been committed. The committee has summoned vice president Boediono and finance minister Sri Mulyani who respectively as central bank governor and finance minister in 2008 decided the bailout to testify before the committee.
