(JG Photo/Afriadi Hikmal) Suspended Youth and Sports Affairs Ministry secretary general Wafid Muharram became the first official convicted of graft in the Southeast Asian Games athletes’ village scandal on Monday, when he was sentenced to three years in jail for corruption linked to a construction project. “The defendant, Wafid Muharram has been convincingly and legally proven to have engaged in the crime of corruption,” judge Marsudin Nainggolan said at the Jakarta Anti-Corruption Court. Besides the three-year sentence, Wafid was given a Rp 150 million ($16,500) fine, or three months of additional jail. Marsudin said Wafid was proven to have accepted three checks worth Rp 3.29 billion on April 21 in return for awarding the Rp 191 billion athletes’ village project in Palembang to private construction company Duta Graha Indah. “The defendant, as a state official, should not have sought compensation. The defendant should have refused the gifts, but instead he claimed they were loans or advance money,” Marsudin said, adding that although the defendant regretted his actions, his deeds did not support the government’s declared battle against corruption. Speaking after the verdict was read, Wafid said he didn’t know whether he would appeal the verdict or sentence, which was half of what prosecutors had recommended. Prosecutor Agus Salim said he needed time to decide whether to appeal the sentence. The prosecutors had asked the court to use a reverse burden of proof system, where Wafid would have had to prove that whatever wealth he had was lawfully gained. But the court, citing a lack of supporting legal framework, did not comply. The panel of judges ordered that the $5,000 confiscated by Corruption Eradication Commission (KPK) investigators from Wafid’s office be returned to him. Marsudin said that because the $5,000 “has not been proven to be linked to the crimes that the defendant is being accused of, it should be returned.” The court also ordered the return of two bank account books, from BRI Britama and Bank Mandiri, that were issued in Wafid’s name. When KPK investigators raided Wafid’s office at the ministry, they found the three checks and a safe that was later found to contain Rp 99 million, 170,000 Australian dollars ($169,000) and 3,765 euros ($4,900). The checks were from Duta Graha Indah marketing manager Mohammad El Idris, and Mindo Rosalina Manulang, the marketing director of Anak Negeri, a company owned by former Democratic Party treasurer Muhammad Nazaruddin. Idris has been sentenced to two and half years in prison, while Rosalina received a three-year sentence. The same case has caught Nazaruddin, who is now awaiting trial. Nazaruddin involvement in alleged illicit behavior extends to at least 10 different cases. Nazaruddin has since accused many Democratic Party cadres of involvement in corruption, including Party Chairman Anas Urbaningrum, lawmaker Angelina Sondakh who sits on the House Budget Committee, and several other party executives.
