Torvalds had one of his famous hissy fits over that clause and gave a
well reasoned argument that the clause was not really necessary for a
project to move to gpl3.  Whether that view is from him talking to Red
Hat's legal team or just his opinion, isn't clear.

I just don't see Zenimax having a problem with using their newer code
within their older code as long as the new license is followed.
