IMHO the spam provision is brilliant, as long as they let you off with a warning the first time. If it's not legal it damn well should be. It's not that hard to keep a machine secure, if you must use an insecure OS then there are plenty of hardware firewall solutions available. What do you expect the ISP to do - sit back and watch customer machines spew spam until other ISPs start to block your entire IP range? The alternative is to say "spam or allow your machine to be hijacked by spammers and we pull the plug on you" which is not too popular. Doing nothing is not an option.
