There's a difference, I think, between Wi-Fi access that's being deliberately offered to the public, whether at a library or at a business, and someone's home Wi-Fi router that they've neglected to properly secure.
Not, in practice, that it's all that enforceable...just that there's no guarantee that the access will continue to be there.
