A "silent STA" allows a station to be off the air, but does not mandate that it remain off the air.

It's possible (and not uncommon) for a station to request silent STA and then notify the FCC verbally that it has returned to the air. It may not be reflected in CDBS, and it may be annoying to us as DXers trying to figure out who's on and who's off, but it's kosher nonetheless in the eyes of the FCC.
