wa Rahmatullaahi wa Barakaatuhu Dear Brothers and Sisters,
Some of you may have recently received a
"Humble request for your kind help" from someone by the Muslim name of Anis Ahmed Shariff requesting
for financial assistance.
I have some concerns that Anis
Ahmed Shariff's email was forwarded by some of our well-meaning Muslim
brothers and sisters without proper verification of the authencity of his
claims(his message is attached below).
I state this based on previous emails
which I have personally received from him dating back to July 11, October
29 and December 29 in 2003, respectively.. A quick
search showed that Anis Ahmed Shariff had been sending the
same message -
quote: Due
to my mothers old age multiple organ failure probelms, I had to meet lot of
expenditure on medicine and her hospitalisation for which I had taken a loan of
Rs. 2,50,000=00 from the bank. -
unquote, which remained unchanged for three (3) years, from
2002 to 2005:

why Anis Ahmed Shariff only requested the same amount of money (Rs.
2,50,000=00) during this three (3) year period to repay the
loan to the State Bank of Mysore. Another
quick search indicated that the State Bank of Mysore is a Hindu
bank which charges interests on loans: http://www.mysorebank.com/fin_position.htm ,
http://www.mysorebank.com/fairpractice.htm
(therefore it is not an Islamic Bank).
This raises the following
questions:
1. Why would a Muslim take a loan
from a Hindu bank which charges interest when he, a Muslim as he claims to be,
should
know very
well that the Sharee'ah forbids
ribaa (usury, interest) -
quote: "Sir, the interest rate so high (18 %) I could
not even pay
the interest.?" -
unquote. Dealing in
ribaa is absolutely prohibited in Islam, whether it is amongst Muslims or
between
Muslims and non-Muslims, whether they are
harbiyeen or not. (Fataawaa al-Lajnah al-Daa�imah,
13/19)
2. Since the Bank charges interest, why was
the amount Anis Ahmed Shariff needed to repay his loan (after three
(3) years) still remained at Rs.
2,50,000=00?
3. Why was Anis Ahmed Shariff not made a
bankrupt by the Bank for three years of non-payment?
4. Why would the Bank (Vishweshwara
Nagar Branch) allow him to open a second bank account when he
was unable to
repay his
outstanding loan, as evidenced by the two
different bank account numbers Anis Ahmed Shariff provided in
his "humble
request messages" (see below) in 2003 and
2005, respectively?:
Whether Anis Ahmed Shariff is a confidence trickster
or whether he is genuinely in financial trouble (and Allaah Ta'aala
knows all), the above questions needed to be asked, thought through
clearly step-by-step for evaluation before forwarding his message or
sending him any money.
If a non-Muslim is in need and asks for financial
assistance, a Muslim is permitted to give charity, but it is not
permissible to give zakaah funds to the poor
among the kuffaar, because zakaah can only be given to Muslims to spend on the
poor and needy among them.. Imaam
al-Shaafa'i said: "There is nothing wrong with giving charity to
a mushrik as a naafilah (supererogatory) action,
but he has no right to charity from the obligatory (zakaah)." Allaah
Ta'aala praised
people who, as He Ta'aala says (interpretation
of the meaning): �� they give food,
inspite of their love for it
(or for the love
of Him), to the Miskeen (the poor), the
orphan, and the captive� (al-Insaan
76:8) . � (Kitaab
al- Umm, part
2).
However, if the person who is asking for money (regardless of whether he is a Muslim or
a non-Muslim) - in order to pay off an interest
based loan, or
he is going to use the money to help him to do
something haraam (prohibited), then it is not permissible for a Muslim
to send funds to him, because by doing so, the Muslim is helping/endorsing
him to engage in ribaa which is forbidden by Allaah
Almighty, Who says
(interpretation of the meaning):
If
anyone receives Anis Ahmed Shariff's email, do not forward it. I have forwarded
this email together with his email to the proper authorities at the State Bank
of Mysore for their attention and action.
