Supreme Court of Canada Grants CAF the Right to Argue that the Security Certificate Regime Discriminates against Arabs
TORONTO – The Canadian Arab Federation (CAF) is pleased that the Supreme Court of Canada has granted CAF the right to intervene in Charkaoui v. Minister of Citizenship and Immigration.  The case is one of three security certificate cases, including Almrei and Harkat, to be heard June 13 -15, 2006 in Ottawa concerning the constitutionality of secret trials of Arabs in Canada.
CAF will be arguing that the security certificate regime violates the Charter of Rights and Freedoms because it discriminates against the Arab community. Adil Charkaoui is a Moroccan who was detained in Montreal in May 2003; Hassan Almrei is a Syrian refugee who has been detained in a Toronto jail since December 2001; and Mohamed Harkat is an Algerian held in Toronto since October 2001.  They have been accused of having links to terrorism without knowing the case against them and without an opportunity to respond to these serious accusations.   
Faraj Nakhleh, Acting President of CAF stated, “While facially neutral, the effect of the security certificate regime denies Canadian Arabs the right to participate as full members of Canadian society, free from stigma and racial profiling that is based solely on their membership of a particular racial or religious group.  The historic targeting of minority groups in times of emergency, such as the Japanese during World War II, is being revived in the context of Arabs and Muslims and Canada's participation in the "war on terror".” 
Prominent members of the Canadian Arab community, such as Issam Al-Yamani of Palestine House, have also been impacted by the discriminatory laws. 
Respected human rights lawyers Douglas Elliott and Gabriel Fahel will represent CAF before the Courts.  CAF was granted intervener status along with the Canadian Bar Association, the Federation of Law Societies, Amnesty International, Human Rights Watch, the Canadian Council of American Islamic Relations, and the Canadian Civil Liberties Association.
