The question is whether your option 1 makes sense.
Wouldn't it then be:
 * log4j is detected on web
 * log4j log factory fails to load on web as commons-logging is missing
 * slf4j is detected on web
 * slf4j log factory fails to load on web as commons-logging is missing
 * legacy log factory fails to load on web as commons-logging is missing
 * slf4j is detected on custom
 * slf4j log factory is loaded on custom

Unless there are situations where the log4j log factory cannot be loaded on web,
but one of the others can be loaded on web, i.e. it does not fail because 
commons-logging is missing,
I'd say it is just wasted time and should be
 * log4j is detected on web
 * log4j log factory fails to load on web as commons-logging is missing
 * slf4j is detected on custom
 * slf4j log factory is loaded on custom
