I had a look at the testcase by running it alone (after an office first start)
and "step by step". At no time was that button visibly enabled, but the warnlog
came anyway. For some reason, the state of the button is not checked directly
(I would expect something like "....isEnabled").

When the user decides to not participate after he started the office for the
second time, the current.csv gets never written and that button gets never
enabled. If the user clicks the "Yes, I wish to participate" button in
Tools-Options-OOo-Improvement Program, then the file is written as soon as the
user clicks OK. 
Re-opening the dialog and then clicking "No" removes the last entries from the
file but does not remove it physically. 
The button is enabled as long as the file current.csv is there, regardless of
the content.
