I will move to a lucene issue and rename as it impacts the whole build and i 
have a lucene-core only example here.

Ishan: maybe it does not fail tests for you anymore, because maybe jetty update 
behaves better and e.g. catches securityexception when scanning classpath or 
who knows. This extra stuff should not be in the tests classpath, so I want to 
try to address that.
