According to the xml spec
http://www.w3.org/TR/2006/REC-xml-20060816/#sec-prolog-dtd
"The document type declaration MUST appear before the first element in the
document."
So adding the license before it makes it an invalid xml document.
I couldn't find any info on whitespace before the document type declaration.
