In gump Ivy doesn't download anything and we have the same problem there...
But you mention an interesting problem. Is there a way to solve this? For instance: could this be solved on local builds by forking the junit task and setting the 'includeantruntime' property to false? You can see the problem if you use the trunk version of ant. Ivy downloads ant.1.6.5.jar into its rep ($IVY_SOURCE/lib), and then uses that from within an ant trunk ant call. The ant.jar on the classpath contains an antlib.xml that has new tasks in it.
