I do agree, that there seems to be a bug with the implementation as you've 
reported. Following is a possible workaround, to achieve the same functionality.

If we specify the complex type named "testing" as following,

<xsd:complexType name="testing">
    <xsd:complexContent>
         <xsd:restriction base="x:base">
              <xsd:choice>
                   <xsd:element name="e1" minOccurs="1" maxOccurs="unbounded"/>
                   <xsd:element name="e2" minOccurs="1" maxOccurs="unbounded"/>
              </xsd:choice>
              <xsd:assert test="count(*) le 9999999" 
xpathDefaultNamespace="##targetNamespace"/>
         </xsd:restriction>
    </xsd:complexContent>
</xsd:complexType>

We would perhaps get the same validation outcome, as intended in your original 
schema in this bug report.
