I did a small test: recreate my xml file directly on the unix system. It
contains only the followings:

<?xml version="1.0" encoding="UTF-8"?>
<JMSProperties>
</JMSProperties>

I am still getting the error!! :o(

I have executed the od -c command on my xml file and do not see any
empty lines before the prolog:

Verify if you have empty lines before prolog[1].

Sometimes i find the "annotated" XML specification[2] more friendly.
