I agree 100%. The project should have been placed in the sandbox because no
one has agreed that it is a commons project and people checking out the
repository might assume that it is which is not the case.

If it is not stated clearly in the charter than I think that a new project
has to go through the same process, even if it consists mainly of code that
was taken from another commons project.
