In which case as you obviously paid more attention to the spec than I did, I suspect 
that this is left over from an older java mail spec, which is hinted at by the subtle 
comment in the code "//This was an older version of JavaMail" DoH! :-D

Therfore I also think its a valid patch, go submit it.
