James currently includes JavaMail, Activation, dns-java and Junit non-Apache-jars without licenses in CVS.
Dion,

We have already made an inventory of what jars we have potential license conflicts with. We're aware of what conflicts we have, what we have permission from authors to use, and what is valid. There are some jars that we bundle because of running under Avalon, and we'll rely on Avalon sorting out and telling us what of those we should bundle.

Incidentally, JUnit is considered the IBM license, which in the emails going around has been dictated as compatible with ASF policy.

The only really at risk files right now are JavaMail and Activation, both which DO have license files in CVS, and once more, it's not completely settled as the discussion is still active. Certain board members has stated there is a problem, and so we've proactively reviewed the issues and are prepared to act when the foot drops.
