That happened to me, when I made some changes to the jserv config files,
and I tried to issue apactl restart, the problem with that is that
sometimes jserv does not finish before apache tries to restart it that's
when that error may appear.
What  I did was to stop apache server with jserv as well, wait for a
minute (check your processes) as soon as jserv is killed, then you can
start apache again.
