I don't have a pointer to the actual discussions but I'm sure one could be found. With regard to the Sun stuff, I know that their license explicitly allowed redistributing the servlet jars, but I don't have any intimate knowledge of the files you refer to beyond that. I imagine the Tomcat team has covered this ground before.
