Basing transperancy on bounding boxes kind of makes sense, but does that
require that every object be at the root level.

For example we have created a mall scene.  It is designed in max and then
imported into our program.  The scene is named as follows

mall.store.01.walls
mall.hallway.west.railing
mall.hallway.west.walls
mall.hallway.west.window01

The transparent textures are sometimes visible through the entire mall.  We
could change the naming, but it would cause all of the art to be on the root
level.

What is the acceptable way to handle this kind of situation as the bounding
boxes will be overlapping as well as there is also one large bounding box
covering the whole scene?

I still get some strange problems looking at solid and transparent objects
through transparent objects.
Remember that transparency sorting is based on the bounding box information
to get the correct depth sorting. I think you're seeing artifacts of the
bounding box not being set correctly for the shape.
