would mean.  'Java' is a trademark which is applied to software which
is certified as being conformant to the spec.

"Can't call it Java unless you pass the TCK" -- Yes.. You can get the
TCK, under a non-open-source license

"Not the right license" (for the TCK) -- That's a matter of debate.

"OpenJDK is open" -- Yes, GPL2+Classpath, and you can build a complete
JDK out of it.
