This happens all the time, large corporations taking preemptive measures to protect IP. I bet Microsoft has a lot in their arsenal they could use, haven't we really only seen them use the FAT patent used (against TomTom) which was rather trivial to work around anyway?
In any event, it would seem Snoracle has the cash and motivation to question Microsoft in court though no?
