Again, this is not a valid point. The patents that Oracle is trying to enforce against Google are about some basic principles of a VM and are as old as the 'TODO' thing, and in the meantime many manufacturers developed similar technologies. But the bomb exploded in delay (ok, one could argue that there was the defensive-only attitude of Sun, but I don't think it really made a difference). Again, we must think as a patent just as a weapon waiting for a casus belli to be used.
