How do you understand #2?

I can't tell if the spec only is ok, or if the "compliant" bs applies only
on modifications of the source code they distribute?

JMX deliverables include:

 the Specifications.

 the Reference Implementation (RI) in source code form, and usable under
Sun Community Source License (SCSL). In order to foster wide adoption, the
commercial use and deployment of the Reference Implementation are free. In
order to ensure compliance, only compliant implementations can be
commercially used or re-distributed. Compliance requires licensing of the
Technology Compatibility Kit (TCK).

 the Technology Compatibility Kit (TCK), is accessible to the JMX licensees
from the Java Licensee Engineering (JLE) website. The TCK license agreement
is bundled with a support contract, provided by JLE for $50K per year.

 the Reference Implementation in binary code, and free for use and
redistribution.

||Oups. But I think as long as we do not say that it is "JMX Compliant" then
||we should be still able to create a JMX Agent (in this case: not
||compliant).
||If not then forget it.
