The problem is not has Sun considers JBoss for-profit because of the association with The JBoss Group. The problem is Sun won't let The JBoss Group purchase access to the TDK like any other company.
The won't give it to JBoss and they won't let The JBoss Group buy it, so they effectively block opensource from J2EE on a technicality.
