The thing is:

1) You can definitely use a WAR inside an EAR and still use jsr181 WebServices.

There is only one caveat: your WAR's context root can't be the same as your 
EAR's name. That is if your EAR's name is cm.ear, then your WAR's context root 
MUST BE SOMETHING ELSE. For example "cmweb". 

Here is an example of how you should pack your cm.ear to get all thing working:

  | <!DOCTYPE 
  |     application PUBLIC
  |             "-//Sun Microsystems, Inc.//DTD J2EE Application 1.3//EN"
  |             "http://java.sun.com/dtd/application_1_3.dtd";

  |     <display-name>RUCAS</display-name>
  |     <module>
  |             <ejb>rucas.jar</ejb>
  |     </module>
  |     <module>
  |             <web>
  |                     <web-uri>rucas.war</web-uri>
  |                     <context-root>/rucasweb</context-root>
  |             </web>
  |     </module>
  | </application>
