Do you have the proper rights for it to write to your cms directory?

The stack trace and FileUpload use is correct:

List fileItems = upload.parseRequest(aReq);

Try creating an html file and see if it saves. Then, try uploading a different 
file with a basic filename "foo.gif" and see if that works.
