In Jenkins 1.581, Jenkins will try to install the tool into the directory specified by MAVEN_HOME in this case. I don't know whether this is deliberate, but I'm sure someone is deliberately using it.
Since there's a very obvious error message if this fails, I don't think this should be changed.
