Plaintiff argued the misrepresentation was premised on Gatzaros's statements the rezoning of the property at issue would not be a problem because he had a relationship with the City of St. Clair Shores where the facility was to be built. The court concluded the representation regarding the likelihood of success of a request for rezoning was clearly not based on a statement of past or existing fact, and was more like a promise Gatzaros did not keep. A claim for misrepresentation predicated on such a fact must fail. Affirmed.
