On this date in alternate Joni history:

Joni Mitchell tried country club life, seeking to be Chuck Mitchell's
domestic spouse and housekeeper.  However, she is so enraged at the
decision against the Detroit Boat Club - which means that Joni will
never be able to build a cabana on Lake St. Claire and fulfill her dream
as a suburban matron - that she puts down her apron, picks up a guitar,
heads to downtown Detroit to sing the blues, and the rest, as they say,
is history.

The trial court did not err in granting defendants summary disposition
on the basis of the alleged misrepresentation because there was no
genuine issue of material fact regarding the misrepresentation related
to defendant-Gatzaros's statement that his offer to build a facility for

plaintiff was subject to zoning approval. Plaintiff argued the
misrepresentation was premised on Gatzaros's statements the rezoning of
the property at issue would not be a problem because he had a
relationship with the City of St. Clair Shores where the facility was to

be built. The court concluded the representation regarding the
likelihood of success of a request for rezoning was clearly not based on

a statement of past or existing fact, and was more like a promise
Gatzaros did not keep. A claim for misrepresentation predicated on such
a fact must fail. Affirmed.
