apparently there are different issues in the isXML method and results in IE
vs Others are different. I have a xml example file plus a simple test case
like:

onload = function(){
    var xhr = new XMLHttpRequest;
    xhr.open("get", "build.xml", false);
    xhr.send(null);
    alert(Sizzle('module[ref="1002"] lessons lesson',
xhr.responseXML).length);
    alert(Sizzle('module[ref="1002"] lessons lesson',
xhr.responseXML.firstChild).length);
};

errors plus wrong results (2 in firefox, 0 in every IE)

not sure I can attach files directly here, if you are interested ... maybe
in a related bug, if any (?)
