Seems to be a browser quirks, wich isn´t adressed by jQuery yet. Although this is very strange, i don´t think it is an important problem:
a) This odd behavior already exists in jQuery 1.3. b) If you manually click on the submit button, you can prevent the submit and if you trigger submit you programmaticly you can prevent submit, too. I´m only using this technique to submit a form, if someone was to stupid to don´t name the submit-button "submit".
