my problem is very similar, my sortable items and the sortable lists are 
position: relative. But when I tried to build a test-page these styles 
alone wouldn't trigger the problem. I am guessing that it is not caused 
by a single part of the code, but by the mass of dom operations taking 
place in addition to the regular jquery.ui stuff.
My current workaround is to put a 
setTimeout('$("body").css("display","block")', 10); in the 
deactivate-event function of the sortable. This causes the IE to 
re-render the page and works in most cases. You may need to adjust the 
delay of the timeout depending on the complexity of your application.
