It kind of makes sense to fix that leak in compatmode. It doesn't affect the display of the page directly but it would affect the browser, regardless of compatmode. Otoh, if they have a fix for it they ought to push it back for at least ie8. But I guess that's just typical msft at work. (Note that the compat modes are all slightly different from the browsers they emulate, I'm sure everyone can tell you a story how something works in IE7 compat but not in the real IE7. The same, as you see now, goes for IE9's compat mode, and it's not surprising.
