Yes that was an error of me trying to indicate what was the reason for
the failure without paying too much attention.
You gave the correct reason for the failure, there were no "OL"
sibling of "DIV". Thanks for the correction.

There is maybe a misunderstanding over what I wrote, as "live state" I
mean the DOM property not the original source attribute:
input:checked // use the DOM property to resolve
input[checked] // use the HTML source attribute to resolve
