I don't know if this might be what you want but how about if you try this:

ResultSet rs = ps.executeQuery();

boolean b = false;

while (ps.next()) {
        boolean b = true;


}

if (boolean b == false) {
        out.println("the resultset is empty");
}

Hope it is what you wanted.
