بسم الله والحمد لله والصلاة والسلام على رسول الله Bismillah Walhamdulillah Was Salaatu Was Salaam 'ala Rasulillah English & Arabic Installment Sales-2- البيع بالتقسيط-2- *Question: *is it permissible to impose a condition for compensation on well-off debtors if they postpone the installment payments?** * Answer:** *It is *haram* for well-off debtors to postpone the installment payments. In spite of this, it is not permitted by the *Shari’ah* to impose a condition for compensation, in cases of delayed payments. *Question: ** *is it permissible to impose a condition that the entire installment payments shall become due before their former date? *Answer:** * In a deferred payment sale, it is permissible for the vendor to impose a condition that the entire installment payments shall become due before their former date, if the buyer delayed in paying some of the installments, as long as the buyer consented to this condition at the time of contract agreement.* * *Question: *is it permissible to the seller to maintain ownership of the item till obtaining the deferred installments? *Answer:** *After the sale has been concluded, the seller has no right to maintain ownership of the item. However, it is permissible for the vendor to mortgage the sold item as security of his right to obtain the deferred installments. *السؤال:* هل يجوز شرعاً اشتراط التعويض في حالة مماطلة المدين المليء؟ *الجواب:* يحرم على المدين المليء أن يماطل في أداء ما حل من الأقساط، ومع ذلك لا يجوز شرعاً اشتراط التعويض في حالة التأخر عن الأداء. *السؤال:* هل يجوز شرعاً اشتراط حلول الأقساط قبل مواعيدها؟ *الجواب:*يجوز شرعاً أن يشترط البائع بالأجل حلول الأقساط قبل مواعيدها، عند تأخر المدين عن أداء بعضها، ما دام المدين قد رضي بهذا الشرط عند التعاقد. *السؤال:* هل يجوز شرعاً للبائع الاحتفاظ بملكية المبيع بعد بيعه حتى استيفاء الأقساط المؤجلة؟ *الجواب:*لا يحق للبائع الاحتفاظ بملكية المبيع بعد البيع، ولكن يجوز للبائع أن يشترط على المشتري رهن المبيع عنده لضمان حقه في استيفاء الأقساط المؤجلة. والحمد لله الذي بنعمته تتم الصالحات Wa Al’hamdulil’laahi Allathee bini'amatihi tatimmu As-salihaat praise is to be to Allah Who by His blessings all good things are perfected Thank You; Iman Sameer Al-Bage, MA (Pending) in Islamic Economics Da’awa University Institute for Islamic Studies Website: http://kantakji.com/elearn_center/islamic.htm Email: [email protected]
