Hi, What I find here in the kernel/mutex.c:86 is that there is a function __sched_mutex_lock in which I find might_sleep function call on line no. 86, which implies that if no lock is acquired it would sleep till it gets it. I am a bit surprised about you having no sleep nor delay there. I assume, you are on the 2.6 kernel.
