That still wouldn't be legal, though -- the OpenSSL licence is incompatible with the GPL, and the result is undistributable, so any time the KiCad project ships binaries, that happens in a grey area anyway. Ideally, we'd drop OpenSSL and use GNUTLS -- libcurl can be linked against GNUTLS, and if we don't use any other crypto functions and only explicitly link against OpenSSL because it needs special initialization magic, that would be the sanest way to go.
