I believe the only way that can happen is if someone uses "Reply to All" instead of just "Reply" in their mail client of choice. Apple Mail appears to behave such that either option will only send a reply to the list address, whether that's correct or not. I believe KMail will cc: the original recipients and sender in addition to the contents of the Reply-to: header if you use "reply to all" instead of just "reply".
I have no idea if mail apps alter their behavior based on the presence of mailing list headers in the message, though it's entirely possible.
