It is not clear. It is also not clear that they are even valid binaries.
And by the way, the "GNU guys" don't own(or most likely don't own) any of the code being released(or "not yet released" as you call it), so what legal ground would they have to send a letter?
Actually, that is probably not true. The GNU folks almost certainly hold the copyright on some piece of software inside Linux. They are certainly entitled to send the letter for that.
